Variance to allow a pool and spa to encroach into the setback
I support this variance. Not only has Applicant shown how his property is negatively impacted should strict setback enforcement be followed here, he has shown numerous pools on the properties near this one with pools within 20 feet of the back lot line. One such pool, at 6919 E. Vista was built with a permit granted in April of 2022. Also, the active alleyway, with 6-foot-high block walls along both sides is an adequate noise buffer for the neighbor to the west. Please grant this variance.
In addition to the examples of non conforming pools, 6919 E Vista Dr was granted a permit BD21-44395 for a new pool which clearly is not 20 feet from the back property line. Rick Jellies has made a Herculean effort to explain to Board of Adjustment how antiquated R-18 zoning is and that our properties should be improved upon without one variance submittal after another. TPV should update the zoning without asking the 200 or so owners of such properties to undertake the expense of review.
